Project Manager's Tools for Procurement and

Contract Administration

This highly interactive course is specifically designed for public sector agency employees who are interested in learning and refining their understanding of the tools for procuring and administering design-build and Public-Private Partnership (P3) projects. The program leader is Mike Loulakis, CEO of A/E/C Training Technologies and the president/CEO of Capital Project Strategies, LLC. Mr. Loulakis has extensive experience in advising owners on how to effectively manage and execute their capital projects, and protect their interests on design-build and P3 projects. He has a long and distinguished career in working on some of the largest design-build projects in the country, including the Dulles Corridor Metrorail project. The program will be taught through a series of workshop problems, requiring each participant to work through real-life challenges. There will also be case studies involving VDOT design-build and P3 projects. Topics to be covered include:

  • Project Selection and Procurement - Key Concerns and Concepts. A review of key procurement principles, including major risks to consider and avoid in project selection while focusing on developing solid Requests for Proposals and risk assessment in project selection and delivery. Special attention will be given to effectively administering qualitative selection processes and avoiding bid protests.
  • Analysis of Key Elements to the Design-Build Contract.  An in-depth review of the design-build contract, including the clauses that are central to proper contract administration. Special attention will be given to VDOT's current standard form design-build contract.
  • Design-Build Contract Administration and Execution.  A focus on changes to the work, differing site conditions, time-related claims, single point of responsibility, claims between contractors and designers and indemnity-related issues. Special attention will also be given to conducting and documenting meetings, inspection, interfacing with third parties, and other areas where public owners generally face administrative challenges and risks on their projects.
  • Lessons Learned in Claims Avoidance and Resolution. A discussion of how to manage and resolve claims that commonly arise on design-build and P3 projects, with special emphasis on those claims involving delay, disruption and acceleration. This section will elaborate on real-life challenges involved on actual VDOT design-build and P3 projects.
