Design-Build
Lessons Learned is a one-of-a-kind guide that provides an in-depth
analysis of the court decisions issued in a given year on
design-build projects. An attempt is made to report on every
decision involving a design-build project, regardless of the
nature of the dispute, and explain the facts, legal rationale
behind the decision and lessons learned.
As a result, each
edition of Design-Build Lessons Learned will provide informative
commentary on the practical consequences of the cases discussed.
While the specific
types of cases reported upon vary from year-to-year, there are
many topics that reappear year-after-year.
For example, numerous cases discuss: (a) ownership rights
in the design documents; (b) liability to the design-builder as
the “single point of responsibility;” (c) liability of design
professionals to the contractor for errors in the design; (d) ADA
liability; and (e) conflicts in forming teaming relationships.
Design-Build Lessons Learned will also appeal to those who
are involved in arbitration or mediation of design-build disputes,
as many of the cases discuss these ADR processes.
