This
edition covers numerous EPC-oriented contracts, including cases
involving Bechtel, Zurn, and Fluor/Daniel.
Among the important design-build cases discussed in this
2001 edition are two cases that elaborate upon liability for
deficiencies in performance specification and owner liability for
using bridging documents in procurement (Trataros Construction,
Inc. and Edsall
Construction Co., Inc.). Other
cases of note include Wild-Fire, Inc. v. Laughlin, et al. (disputes
when a design-builder uses stock plans and specifications in
selecting a subcontractor); and Sokoloff v. Harriman Estates
Development Corp. (ability of owner to use plans developed by
a design-builder under an AIA Part 1 agreement).
